It continues to amaze me how after 15 years, I am still running into situations that are new. I have actually been asked this question in the past but never had a client go through it. In episode 70, we talked about this happening and almost a year later, it did.
I had a client whose neighbor had a tree drop a large branch onto their roof causing damage. The situation played out exactly as I was told. His homeowners policy will cover the damage. He wanted to used his neighbor’s policy because he felt she was negligent.
He had multiple conversations over the past few years about trimming this tree back. The missing piece here is proof. He couldn’t prove that he has spoken to her. There was no paper trail or emails to reference. That is ultimately what the insurance company is going to need to see to prove negligence.
